Mixed beverages. Adds a definition of "mixed beverage". Allows the holder of a wine wholesaler's permit to take certain actions concerning mixed beverages and flavored malt beverages. Provides that a wine wholesaler may possess, transport, sell, and deliver mixed beverages to a person who holds a particular permit. Repeals a provision concerning a wine wholesaler that also holds a liquor permit.

Prohibits a governmental body (defined as the state or a state agency) from: (1) accepting payment made with a central bank digital currency; or (2) requiring payment to be made with a central bank digital currency; for any service, tax, license, permit, fee, information, or other amount due the governmental body. Prohibits an administrative branch governmental body (defined as an entity of the administrative branch of state government) from advocating for or supporting the testing, adoption, or implementation of a central bank digital currency by the United States government. Defines "central bank digital currency" for purposes of these provisions.

Provides that, for the 2024-2025 and 2025-2026 school years, a school shall ensure that at least 60% of a school counselor's aggregate time performing the counselor's job duties is devoted to providing direct services to students. Provides that, beginning with the 2026-2027 school year, a school shall ensure that at least 80% of a school counselor's aggregate time performing the counselor's job duties is devoted to providing direct services to students. Exempts schools that have a school counselor/student ratio that is not more than one school counselor to 350 students from the school counselor time requirement provisions. Allows school corporations to provide certain notices regarding expulsion meetings by electronic mail.

Education matters. Increases the maximum amount of the income tax credit for an individual employed as a teacher for amounts expended for classroom supplies from $100 to $1,500 per taxable year. Provides that a student may be suspended or expelled only upon: (1) a determination that the student's suspension or expulsion will prevent or substantially reduce the risk of interference with an educational function or school purposes, disruption of the school learning environment, or physical injury to the student, other students, school employees, or school visitors; and (2) in the case of an expulsion, a determination that all other available and appropriate disciplinary and behavioral interventions have been exhausted. Provides that notice to a parent of: (1) a student's suspension or expulsion must include the rationale for the length of the suspension or expulsion; and (2) the right to appear at an expulsion meeting must include the behavioral and disciplinary interventions attempted, if any, and the rationale for the length of the expulsion. Provides that if a student is suspended, the student must be provided: (1) appropriate and available support services, as determined by the school, during the suspension period; and (2) an opportunity to receive credit for completion of make up work.

Prohibits a person from carrying a firearm in or near: (1) a chute; (2) polls; (3) certain areas where voters congregate or are likely to congregate; or (4) any room where ballots are being counted. Provides that the offense is a Class C misdemeanor, enhanced to a: (1) Class A misdemeanor if the person has a prior unrelated conviction for the offense; or (2) Level 6 felony if the firearm is pointed at another person. Specifies a defense and certain notice requirements. Prohibits other defenses. Changes the minimum age required to carry a handgun to 21 years of age. Makes it a Level 5 felony to possess a privately made firearm. Makes it a Level 5 felony to alter, obliterate, or remove certain marks of firearm identification or to possess a firearm on which those marks of identification have been altered, obliterated, or removed. Defines terms. Makes conforming amendments.

Landlord-tenant relations. Allows a city, county, or town to bring a nuisance action against a tenant or other person responsible for a nuisance. Requires a landlord to repair or replace an essential item not later than 24 hours after being notified by a tenant that the tenant's rental unit is without certain essential services. Provides that a tenant may bring an enforcement action against a landlord by providing notice of the landlord's noncompliance and allows for certain remedies to a prevailing tenant. Allows a court to order that a tenant's regular rental payments are paid into an attorney trust account or to the clerk of the court during the pendency of an enforcement action brought by the tenant.

Education matters. Requires the department of education to prepare and submit a report that includes the department's recommendations regarding the major themes and content areas that should be developed and maintained in Indiana education law. Amends the: (1) definition of "eligible student" for purposes of eligibility under the Indiana education scholarship account program (program); (2) definition of "ESA qualified expenses" under the program to include additional items; and (3) state fiscal year used to determine the annual grant amount under the program. Provides that the treasurer of state shall accept applications July 1 through June 30 of each year for the immediately following school year. (Current law requires applications to be submitted for an eligible student not later than September 1 for the immediately following school year.) Establishes requirements regarding using grants under the program for computer hardware or other technological devices. Removes the following provisions: (1) Certain program agreement requirements regarding enrollment in a school that receives tuition support. (2) References in the program provisions regarding plans developed under Section 504 of the federal Rehabilitation Act of 1973.

Various health care matters. Makes changes to the law governing administrative adjudication and to provisions related to managed care organizations. Provides that if a physician has entered into a provider agreement with the office of Medicaid policy and planning (office) or a managed care organization and the physician, subject to the provider agreement, provides professional services to individuals participating in the state Medicaid program, the office or the managed care organization shall promptly compensate the physician for the professional services in accordance with the provider agreement. Prohibits any delay in or denial of compensation to the physician unless the cause of the delay or denial is specifically provided for in: (1) the Medicaid managed care law; (2) an administrative rule adopted under the Medicaid managed care law; (3) the federal administrative rules on Medicaid managed care; or (4) the provider agreement. Defines "antiretroviral" as a drug used to prevent a retrovirus, such as the human immunodeficiency virus (HIV), from replicating. Provides, for purposes of the Medicaid program and the children's health insurance program, that an FDA approved drug that is prescribed for the treatment or prevention of HIV or acquired immunodeficiency syndrome (AIDS), including antiretrovirals, shall not be subject to: (1) prior authorization; (2) a step therapy protocol; or (3) any other protocol that could restrict or delay the dispensing of the drug. Prohibits a health plan (including a policy of accident and sickness insurance, a health maintenance organization contract, the state employee self-insurance program and prepaid health care delivery plan, and a Medicaid risk based managed care program) from imposing or enforcing: (1) a prior authorization requirement; (2) a step therapy protocol requirement; or (3) any other protocol requirement; if imposing or enforcing the requirement could restrict or delay the dispensing to a covered individual of an FDA approved drug, including an antiretroviral, that is prescribed for the treatment or prevention of HIV or AIDS. States that a home health agency is not required to conduct a tuberculosis test on a job applicant before the individual has contact with a patient. Repeals a statute that requires certain personal services agency employees or agents to complete a tuberculosis test. Authorizes the establishment of home health agency cooperative agreements. (A similar law enacted in 2022 expired on July 1, 2023.) Makes statements and findings of the general assembly concerning home health agency cooperative agreements. Specifies that a home health agency may contract directly or indirectly through a network of home health agencies. Exempts: (1) a remote location of a hospital; and (2) a free standing emergency department or other provider-based entity; from health care billing requirements. Allows a pharmacist to administer an immunization that is recommended by the federal Centers for Disease Control and Prevention Advisory Committee on Immunization Practices to a group of individuals under a drug order, under a prescription, or according to a protocol approved by a physician if certain conditions are met. (Current law allows a pharmacist to administer specified immunizations to a group of individuals under a drug order, under a prescription, or according to a protocol approved by a physician if certain conditions are met.) Removes a provision allowing a pharmacist to administer pneumonia immunizations to individuals who are at least 50 years of age.
