B25-0692 - Enhancing Mental Health Crisis Support and Hospitalization Amendment Act of 2024

As introduced Bill 25-692 would broaden the pool of qualified healthcare professionals authorized to initiate involuntary commitment processes, incorporating Psychiatric-Mental Health Nurse Practitioners with expertise in mental health assessments. It extends the detention time for emergency observation. It extends timeframes for initiation of probable cause hearings and prioritizes virtual hearings. It clarifies the right to voluntarily agree to remain in inpatient status until an appropriate discharge plan is implemented. It would allow doctors to make involuntary admissions, provided their financial arrangements comply with federal law. It allows the court, when appropriate to order for treatment for up to 30 days but not less than 15 days. It would also require the Department of Behavioral Health to develop online training modules for both healthcare professionals and laypersons.

B25-0543 - Eliminating Restrictive and Segregated Enclosures (“ERASE”) Solitary Confinement Act of 2023

As introduced Bill 25-543 would prohibit nearly all forms of segregated confinement for individuals incarcerated at penal institutions owned, operated, and controlled by the Department of Corrections (DOC). It also limits the use of safe cells, would mandate that all residents in a DOC facility receive at least eight hours of out-of-cell time a day, and charge DOC with providing residents mental health services any time they’re placed in prolonged confinement, medical isolation, or suicide watch. It would require DOC to collect and publish data on the ongoing use of solitary confinement, and allow residents to file special grievances, and potentially sue the agency if they’ve been subject to prolonged confinement.
