  • Employer prohibitions and disclosure (amendment to NRS 414.250):

    • Employees/applicants who wish to join a CAP unit must disclose that fact to their employer or prospective employer.
    • Employers that previously could prohibit participation during normal working hours may not prohibit an employee from participating in CAP activities for which the new leave protections apply; employers must notify the employee promptly if they do not allow participation during work hours (except where the leave protections apply).

    • An aggrieved employee may bring a civil action to recover damages equal to lost wages and benefits and may recover reasonable attorney’s fees and costs.
