Terms of Service
Effective Date: January 27, 2026
These Terms of Service ("Terms") are a legally binding agreement between you and WeVote Foundation ("WeVote," "we," "us," or "our") governing your access to and use of the WeVote platform, website, applications, and services (collectively, the "Services").
PLEASE READ THESE TERMS CAREFULLY.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use our Services.
THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 15), WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.
1. Acceptance of Terms
By creating an account, claiming a voter profile, accessing, or using our Services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. We may modify these Terms at any time as described in Section 17.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Be a registered voter in the United States (for voter verification features)
- Be capable of forming a binding contract
- Not be prohibited from using our Services under applicable law
- Not have been previously suspended or removed from our Services
By using our Services, you represent and warrant that you meet all eligibility requirements.
3. Your Account
3.1 Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or use
3.2 Voter Profile Verification
WeVote allows you to claim and verify your voter profile by connecting your account to your public voter registration record. By claiming a voter profile, you:
- Confirm that you are the registered voter associated with that record
- Understand that the claimed profile becomes exclusively associated with your account and is no longer available to others
- Agree to provide accurate contact information for verification
- Acknowledge that your verified status enables you to engage with representatives and participate in civic forums
3.3 One Account Per Person
You may maintain only one account. Creating multiple accounts, or creating an account on behalf of someone else without authorization, is prohibited.
4. Acceptable Use
4.1 You Agree To:
- Use the Services only for lawful purposes and legitimate civic engagement
- Provide accurate and truthful information about your identity
- Respect the rights and dignity of other users and representatives
- Comply with all applicable laws, regulations, and these Terms
- Use the Services in a manner consistent with their intended purpose
4.2 You Agree Not To:
Identity and Verification
- Impersonate any person or entity, or falsely claim an affiliation
- Claim a voter profile that does not belong to you
- Provide false or misleading information during verification
- Attempt to circumvent verification or security measures
Content and Conduct
- Post content that is false, misleading, defamatory, obscene, threatening, harassing, or hateful
- Engage in harassment, bullying, intimidation, or abuse of other users
- Post content that infringes intellectual property rights
- Spam, advertise, or solicit without authorization
- Manipulate or artificially inflate engagement metrics
Platform Integrity
- Use automated systems, bots, scrapers, or similar technologies without our written permission
- Interfere with or disrupt the Services, servers, or networks
- Attempt to gain unauthorized access to any part of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Circumvent any access controls, rate limits, or security measures
- Use the Services to collect information about users without consent
Prohibited Purposes
- Use the Services for commercial purposes without authorization
- Use the Services for political campaign activities in violation of applicable law
- Engage in voter suppression, election interference, or disinformation
- Use the Services to harass or target elected officials or their staff
- Facilitate illegal activities or violate any applicable laws
5. User Content
5.1 Your Content
"Your Content" means any content you submit, post, or transmit through the Services, including posts, comments, messages, images, and other materials.
You retain ownership of Your Content. However, by submitting Your Content, you grant WeVote a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display Your Content in connection with operating and providing the Services.
This license includes the right to:
- Display Your Content to other users and representatives
- Use Your Content to improve and develop our Services
- Use Your Content in aggregated or anonymized form for research and analytics
- Retain copies of Your Content for backup and archival purposes
This license continues even if you stop using the Services, to the extent Your Content has been shared with others, incorporated into our Services, or is reasonably necessary for operational continuity.
5.2 Content Representations
By submitting Your Content, you represent and warrant that:
- You own or have the necessary rights to submit Your Content
- Your Content does not violate these Terms or any applicable law
- Your Content does not infringe the rights of any third party
- You have obtained any necessary consents from individuals depicted in Your Content
5.3 Content Visibility
You understand and agree that:
- Posts, comments, and forum contributions are visible to other users
- Messages to representatives are shared with those representatives
- Petition signatures include your name
- Your username and contextual information (e.g., district) are visible with your public content
- Anonymous activities (votes, likes) are aggregated and displayed without identifying you
5.4 Content Moderation
We reserve the right, but have no obligation, to:
- Monitor, review, or edit any content on the Services
- Remove or disable access to content that violates these Terms
- Take action against accounts that violate these Terms
- Cooperate with law enforcement when required
We are not responsible for content posted by users and do not endorse any user content.
6. Intellectual Property
6.1 WeVote's Intellectual Property
The Services, including all software, designs, text, graphics, logos, icons, images, audio, video, and other content created by WeVote (excluding User Content), are owned by or licensed to WeVote and are protected by copyright, trademark, and other intellectual property laws.
You may not use, copy, reproduce, modify, distribute, or create derivative works from our intellectual property without our express written permission.
6.2 Trademarks
"WeVote," the WeVote logo, and other WeVote marks are trademarks of WeVote Foundation. You may not use our trademarks without our prior written consent.
6.3 Feedback
If you provide feedback, suggestions, or ideas about our Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback without compensation or attribution.
7. Third-Party Content and Services
7.1 Legislative Information
Our Services provide access to legislative information, including bill text, voting records, and representative profiles. While we strive for accuracy:
- We do not guarantee the completeness, accuracy, or timeliness of this information
- Legislative information may change rapidly and our data may not reflect the most current status
- You should verify critical information through official government sources
7.2 Third-Party Links
Our Services may contain links to third-party websites or services. We do not control and are not responsible for third-party content, privacy practices, or terms. Your interactions with third parties are solely between you and them.
7.3 Third-Party Integrations
If you authorize third-party applications to access your account, you do so at your own risk. We are not responsible for the actions of third-party applications.
8. Donations
8.1 Tax-Deductible Contributions
Donations to WeVote Foundation are tax-deductible to the extent permitted by law. WeVote Foundation is a 501(c)(3) nonprofit organization.
8.2 Refund Policy
Donations are generally non-refundable. If you believe a donation was made in error, contact us at support@wevoteproject.org within 30 days.
8.3 Payment Processing
Donations are processed by third-party payment providers. Your use of payment services is subject to their terms and privacy policies.
9. Termination
9.1 Termination by You
You may terminate your account at any time by using the account deletion feature in your settings or by contacting us. Upon termination, your right to use the Services immediately ceases.
9.2 Termination by WeVote
We may suspend or terminate your account or access to the Services at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Conduct harmful to other users, representatives, or WeVote
- Extended periods of inactivity
- Requests by law enforcement or government agencies
9.3 Effect of Termination
Upon termination:
- Your right to access and use the Services immediately ceases
- We may delete your account information (subject to our data retention policies)
- Content you posted may remain on the Services but will be disassociated from your identity
- Provisions of these Terms that by their nature should survive termination will survive
10. Disclaimers
10.1 "AS IS" and "AS AVAILABLE"
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WEVOTE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.2 No Guarantee
We do not warrant that:
- The Services will meet your requirements or expectations
- The Services will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- Any errors in the Services will be corrected
- Legislative information is complete, accurate, or current
- Your communications will reach intended recipients
- Any specific outcomes will result from your civic engagement activities
10.3 Third-Party Content
We do not endorse, guarantee, or assume responsibility for any content posted by users or any third-party content, products, or services.
11. Limitation of Liability
11.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WEVOTE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WEVOTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF WEVOTE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED U.S. DOLLARS ($100); OR (B) THE AMOUNTS YOU PAID TO WEVOTE, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
11.3 Basis of the Bargain
The limitations in this section apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), strict liability, or any other legal theory, and whether or not WeVote has been advised of the possibility of such damages. These limitations are an essential part of the agreement between you and WeVote.
12. Indemnification
You agree to defend, indemnify, and hold harmless WeVote, its affiliates, and their respective directors, officers, employees, agents, partners, contractors, and licensors (the "WeVote Parties") from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Services
- Your Content
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your violation of any applicable laws or regulations
- Any dispute between you and another user or third party
- Any claims that Your Content caused damage to a third party
WeVote reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.
13. Governing Law
These Terms and any disputes arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Nebraska, United States, without regard to its conflict of law provisions.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at support@wevoteproject.org and attempt to resolve any dispute informally for at least 30 days.
15. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
15.1 Agreement to Arbitrate
You and WeVote agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, "Disputes") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that:
- You may assert claims in small claims court if your claims qualify
- Either party may seek injunctive or other equitable relief in court for infringement of intellectual property rights
15.2 Arbitration Rules
Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will take place in Nebraska, unless you and WeVote agree otherwise or the AAA rules provide otherwise. The arbitrator's decision will be final and binding.
15.3 Class Action Waiver
YOU AND WEVOTE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Unless both you and WeVote agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
15.4 Opt-Out
You may opt out of this arbitration agreement by sending written notice to support@wevoteproject.org within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.
15.5 Severability
If any part of this Section 15 is found to be unenforceable, the remainder will continue to apply, except that if the class action waiver is found unenforceable, the entire Section 15 will be void.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and WeVote regarding the Services.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
16.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
16.6 Notices
We may provide notices to you through the Services, by email to the address associated with your account, or by other reasonable means. You may provide notices to us at support@wevoteproject.org.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms on our Services
- Updating the "Last Updated" date
- Sending notice to the email associated with your account (for significant changes)
Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.
