Bill Summary · S 2724

Summary — S.2724 (Commonwealth of Massachusetts)

Status: Referred to Investigations and Government Operations
Introduced: September 4, 2025
Latest committee action: Reported by Senate Ways and Means and substituted for H.4363 (Nov 17, 2025)

Purpose

Authorize the commissioner of Capital Asset Management and Maintenance (DCAMM), in consultation with Massachusetts Bay Community College (MassBay), to convey a small parcel of state-owned land used for community college purposes to a private individual (Kimberlee A. Dow) and to direct the sale proceeds into a scholarship trust for MassBay students.

Key provisions

  • Authorizes DCAMM to convey to Kimberlee A. Dow (or successors/assigns) a parcel of approximately 3,500 square feet identified as “Gravel Driveway” on a May 7, 2024 draft plan for 23 Oakland Circle, Wellesley (deed reference: Norfolk Registry, Book 4990, Page 254). Exact boundaries to be set by the commissioner.
  • The conveyance is exempted from the normal disposal requirements (notwithstanding sections 32–37 of chapter 7C and other law) and is to be made without representations or warranties; DCAMM may impose additional terms and conditions it deems necessary.
  • Purchase price: the greater of (a) fair market value or (b) value in proposed use, determined by an independent appraisal prepared under standard professional appraisal practice and commissioned by DCAMM.
  • Inspector General (IG) review: the appraisal must be submitted to the IG for review and approval, including examination of methodology. The IG must file a report of its review with DCAMM; DCAMM must provide the appraisals and IG report (and any IG comments) to the House and Senate Ways & Means committees and the Joint Committee on State Administration and Regulatory Oversight at least 15 days before executing transfer documents.
  • Transaction costs (engineering, surveys, appraisals, title searches, recording, deed preparation, etc.) are the responsibility of the purchaser (Kimberlee A. Dow or assigns).
  • Proceeds of the sale to be deposited into a new expendable trust: the “Massachusetts Bay Community College Oakland Circle Scholarship Trust,” administered by the president of MassBay. Funds (sale proceeds, gifts, interest) are expendable, without further appropriation, for scholarships for MassBay students; balances carry forward and the trust cannot be overdrawn.

Who is affected

  • Massachusetts Bay Community College: will relinquish a small portion of land used under its care and receive sale proceeds dedicated to scholarships.
  • Kimberlee A. Dow (or successors/assigns): potential purchaser of the parcel, responsible for purchase price and transaction costs.
  • MassBay students: beneficiaries of scholarships funded from the trust.
  • DCAMM and the Inspector General: responsible for appraisal, supervision of the transaction, and reporting to legislative committees.

Procedural notes / timeline

  • Introduced in the Senate 9/4/2025; read twice and referred to Judiciary the same day.
  • Reported by Senate Ways & Means and substituted for H.4363 on 11/17/2025.
  • Requires DCAMM appraisal, IG review/report, and a 15-day notice to key legislative committees prior to executing the transfer.

This bill is narrowly focused on authorizing a specific land conveyance and establishing a scholarship trust funded by its proceeds, with built-in valuation oversight and legislative notice requirements.
