Purpose / Intent

AB 1233 extends existing safeguards used for certificated staff to noncertificated (classified and other nonlicensed) school employees and expands employer disclosure obligations to include private schools. The bill creates a statewide data system to record substantiated investigations of “egregious misconduct” for noncertificated employees to improve hiring checks and prevent rehiring of individuals with substantiated serious misconduct findings.

    • Before hiring for a noncertificated position, LEAs and private schools must check the statewide system to see if an applicant has a substantiated report.
    • Within 30 calendar days of hiring (and within 30 days when an employee changes or adds a noncertificated position), employers must submit employee name, start date, and position title to the system.
    • Within 10 calendar days of an employee leaving a position, employers must submit the final date of employment.
    • Employers must notify the statewide system at both the start and completion of investigations of egregious misconduct; substantiated findings and employee departures during investigations must be recorded. Investigations that result in an unfounded or inconclusive finding may not be recorded.
