New facilities constructed for the state shall comply with standards established under the act, and a state agency requiring building inspections shall comply with the same standards of inspection required under the act. The act specifies provisions for political subdivisions adopting existing building codes by reference, and enacting local amendments to the state code, as provided in the act. There is established within the Department of Commerce and Insurance the "Missouri Building Codes Commission", with membership and duties as laid out in the act, including the establishment of advisory committees. The Commission shall establish fees for the issuance and renewal of certain permits, and shall charge an additional fee, to be collected by political subdivisions for the permits. The Missouri Building Codes Commission shall hold public hearings as part of adopting or amending codes in the manner described in the act. The act further describes enforcement authority of the State Codes Manager, State Fire Marshal, and authorities having jurisdiction as such term is defined in the act. Agricultural buildings shall be exempt from building codes adopted under the act. A jurisdiction adopting the Missouri Building Codes that also requires residential reoccupancy inspections when there is a change in ownership, tenants, or occupants shall use a residential reoccupancy checklist established under the guidance of the Missouri Building Codes Commission as provided in the act. This act is substantially similar to HB 3466 (2026) and SB 743 (2025) and similar to HB 2870 (2024). SCOTT SVAGERA

Legislative bill overview

SB 1431 establishes a comprehensive "Missouri Building Codes Act" that would create a unified statewide framework for building codes and construction standards. The bill standardizes regulations across Missouri municipalities that currently operate under varying local codes, potentially consolidating enforcement mechanisms and updating safety standards.

Why is this important

Building codes directly affect public safety, housing costs, and construction timelines. Fragmented local codes create compliance challenges for contractors working across jurisdictions and can result in inconsistent safety standards. Standardization could reduce regulatory burden on builders while potentially increasing housing affordability or conversely increase costs depending on code stringency.

Potential points of contention

  • Local control vs. state authority: Municipalities may resist state-mandated codes that override local preferences and customizations developed for regional conditions
  • Cost implications: Stricter or updated statewide codes could increase construction expenses, potentially pricing out developers and homebuyers, or conversely, weakened standards could compromise safety
  • Implementation timeline and transition: Existing structures and local enforcement infrastructure would need significant changes; disputes may arise over grandfathering existing buildings and retraining inspectors
