HB141 - An Act To Amend Titles 11 And 15 Of The Delaware Code Relating To Criminal History Background Checks For Candidates For State And County Public Office.

This Act requires all candidates for statewide office, the General Assembly, and all elected county offices, to request a criminal history background check, no later than the filing deadline, from the State Bureau of Identification. The State Bureau of Identification must, within 10 days of receipt of the request, provide the Commissioner of Elections with a report of the candidates criminal history or a statement that the Bureaus Repository contains no information relating to the candidate. The Commissioner of Elections must then determine if the candidate is qualified under Section 21 of Article II of the Delaware Constitution to be considered a candidate and have their name appear on the ballot. The candidate will be considered a provisional candidate until the Commissioner of Elections determines the candidate is qualified. The information obtained by the Commissioner of Elections, from the Bureau, will not fall under the definition of public record in Chapter 100 of Title 29. The candidate must pay the cost of the criminal history background check, but the cost may be reimbursed from the candidates campaign funds as an authorized campaign expenditure. This Act will take effect January 1 after enactment.

This Act, known as the Delaware Climate Change Solutions Act of 2023, follows the issuance of Delawares Climate Action Plan in 2021, and establishes a statutory target of greenhouse gas emissions reductions over the medium and long term to mitigate the adverse effects of climate change due to anthropogenic greenhouse gas emissions on the State. The Act establishes a process of regular updates to the Climate Action Plan to serve as the framework to achieve the targeted emissions reductions and develop resilience strategies for the State, creates Climate Change Officers in certain Key Cabinet-Level Departments who will assist DNREC in the ongoing implementation of the Climate Action Plan, requires State agencies to consider climate change in decision-making, rulemaking, and procurement, and requires an Implementation Report every 2 years on the progress of the State towards meeting the statutory targets.

This Act creates a separate offense for theft of a catalytic converter. A first offense of catalytic converter theft is a class A misdemeanor unless the value of the stolen property is $1,500 or more, in which case it is a class G felony. A second offense of theft of a catalytic converter within the previous 5 years is a class G felony, regardless of the value of the stolen property.

This Act limits those individuals who may possess a firearm at a polling place on an Election Day to the following: (1) law enforcement officers, (2) commissioned security guards acting in their official capacity, (3) constables acting in their official capacity, and (4) active-duty members of the United States Armed Forces and Delaware National Guard acting in their official capacity. This Act is applicable to any in-person election held under Title 15, any local school election held under Title 14, and any municipal election held in accordance with the municipality's charter, ordinance, or code, and includes locations designated for early voting. This Act also provides an exemption for individuals who reside or visit private property adjacent to a polling place, or who are traveling from private property to another location.

This Act updates the crime of official misconduct to ensure appropriate accountability of public servants who abuse their positions of power and public trust. The statute establishes a grade in the penalty for the official misconduct to be commensurate to the gravity of the misconduct. In addition, this statute conforms the discrimination language to the language used in the Hate Crimes statute. It also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

This Act amends the renewal period for obtaining background checks for employees of the Department of Labor who have access to Federal Tax Information. This amendment is necessary to conform to revisions of the federal Internal Revenue Service in Publication 1075, which shortened the renewal period from 10 to 5 years. The language is intended to allow conformity with this and any future revisions to the renewal period.

This Act requires the Secretary of Education to publish and deliver to the General Assembly a report detailing requests for certificates of necessity that are not included in the proposed capital budget and the reasons for the rejection and a ranking of the rejected projects by need. The report is also required to include a breakdown of the current and previous 5 years of state spending committed through the certificate of necessity process, as well as a report on which priority level (1, 2, or 3) all approved and rejected applications are given.
