SB 1688

SB 1688 - This act establishes the "Missouri Downtown and Rural Economic Stimulus Act Extension Act" (MODESAEA). The act provides that provisions of expired law establishing the Missouri Downtown Rural Economic Stimulus Act (MODESA) are extended. The act allows development areas and development project areas approved under both MODESAEA and MODESA to be modified. Any debt obligations issued to carry out a development project shall be extended to thirty-five years. One hundred percent of payments in lieu of taxes and eighty-five percent of economic activity taxes generated in relation to an expanded development project shall be used each year of the approved term to support development project costs. An office displacement and retail or restaurant displacement percentage shall not apply to an expanded development project. (Section 99.1260) The act requires the Department of Economic Development to disburse the state construction income tax increment to support development project costs. Such disbursements shall cease within 180 days of the date on which the Department determines that the construction of the expanded development project is complete and has opened to the public. The Department shall disburse the residential income tax increment to support development project costs for a period not to exceed thirty-five years. The developer shall elect how to calculate the amount of such disbursement. (Section 620.1265) A developer shall apply to the Department for approval of an expanded development project, as described in the act. (Section 620.1270) The act authorizes the Department to promulgate temporary rules that shall expire not later than two years following the publication of the temporary rules. Thereafter, such rules shall be promulgated as provided in current law. (Section 620.1275) JOSH NORBERG

Legislative bill overview

SB 1688 extends Missouri's Downtown and Rural Economic Stimulus Act (MODESA), allowing previously approved development projects to be modified and expanded. The bill extends debt repayment periods to 35 years and redirects tax increments (payments in lieu of taxes, economic activity taxes, and construction/residential income taxes) to fund expanded development projects.

Why is this important

This legislation affects how Missouri incentivizes downtown and rural economic development by extending financial commitments and modifying the terms of existing tax-based incentive agreements. It directly impacts state revenue allocation, municipal budgets that rely on tax increment financing, and the viability of development projects in economically targeted areas.

Potential points of contention

  • Revenue trade-offs: Diverting 100% of payments in lieu of taxes and 85% of economic activity taxes to development projects reduces funds available for general municipal services, schools, and other public needs for up to 35 years
  • Developer discretion: Allowing developers to elect how to calculate residential income tax increment disbursements creates potential for inconsistent application and may lack transparency in public accountability
  • Retroactive expansion: Modifying previously approved projects after the fact raises fairness questions about changing the original terms and may set precedent for continuous renegotiation of development agreements
  • Vague completion standards: The 180-day threshold for ending construction tax increment disbursements after a project "opens to the public" lacks clear definition and could lead to disputes
