AB 385 — Glen Helen Regional Park Property (Ramos)

Status: Introduced February 3, 2025. (Record notes: “Pursuant to Joint Standing Rule No. 14.3.1, no further action allowed.”)

Purpose / Intent

Authorize the County of San Bernardino to dispose of up to 4.2 acres of land at Glen Helen Regional Park (including land acquired or improved with state grant funds) provided the county acquires replacement park property of equal or greater recreational value. The Legislature states its intent that the exchange/instrument serve to increase recreational opportunities in the county.

Key provisions

  • Scope: “Glen Helen Regional Park property” is defined as the specific 4.2 acres to be disposed of by San Bernardino County (acting through its Regional Parks Department).
  • Authorization: Notwithstanding other law, the county may dispose of up to 4.2 acres at Glen Helen Regional Park — including land acquired or improved with Roberti‑Z’berg‑Harris Urban Open‑Space and Recreation Program (and similar) grant funds — only if specified conditions are satisfied.
  • Replacement requirement: The county must acquire replacement park property that:
    • Is approved by the Department of Parks and Recreation;
    • Has fair market value equal to or greater than the greater of (a) the Glen Helen parcel’s fair market value, or (b) the actual sales price (if sold) — except for exchanges where sales price clause does not apply;
    • Has recreational utility to the public equal to or greater than the Glen Helen parcel (as approved by the Department);
    • Is acquired at no cost to the State or to the county.
  • Transfer of grant obligations: Before disposing of the Glen Helen parcel the county must enter into a final, Department‑approved written agreement transferring all county responsibilities and obligations under any applicable state grant contracts from the Glen Helen property to the replacement property in perpetuity.
  • Environmental, title and feasibility documentation (deadlines):
    • Independent appraisal of Glen Helen parcel submitted by July 1, 2026.
    • Plan identifying proposed replacement property by January 1, 2027.
    • Appraisal of proposed replacement property by July 1, 2027.
    • By January 1, 2028: preliminary title reports for both properties; environmental site assessment and county attestation regarding hazardous substances; feasibility study for recreation use; lists of permitted title exceptions and existing liens/mortgages and agreements addressing them.
    • By July 1, 2028: final title reports and a report on remedied and outstanding hazardous conditions before acquisition.
  • Sunset/inoperative clause: If replacement property has not been acquired on or before January 1, 2029, the bill’s authorization becomes inoperative as of that date.

Who is affected

  • County of San Bernardino (Regional Parks Department) — may dispose of the described acreage subject to requirements.
  • California Department of Parks and Recreation — must review/approve appraisals, recreational utility, and final agreement transferring grant obligations.
  • Parties holding title/encumbrances on the replacement or Glen Helen property; users of Glen Helen Regional Park; and the public interest in state‑funded parkland protections under the Roberti‑Z’berg‑Harris program.

Fiscal / procedural notes

  • No state appropriation required (Digest: “Appropriation: NO”). Fiscal committee review noted.
  • The bill creates a limited, conditional exception to restrictions governing disposition or change of use of parkland acquired or improved with certain state grants; it imposes multiple procedural steps and deadlines to protect grant‑funded park values prior to disposal.
