Bill Summary · AB 41

Summary — AB 41 (BDR 36-267)

Chapter 100 — Approved by the Governor (May 29, 2025). Effective July 1, 2025.

Main purpose

AB 41 amends Nevada law governing the Governor’s military staff to create a statutory Deputy Adjutant General (Deputy TAG) position and to adjust related appointment, succession, and classification rules for senior Nevada National Guard officers. The change is intended to strengthen state National Guard leadership, continuity, and joint (Army/Air) oversight.

Key provisions

  • Amends NRS 412.042 and NRS 412.054.
  • Establishes a Deputy Adjutant General:
    • The Adjutant General may appoint one Deputy Adjutant General from the Nevada Army National Guard or the Nevada Air National Guard.
    • The Deputy Adjutant General is placed in the unclassified service of the State and, except as provided in NRS 284.143, may not hold another city, county, state, or federal office of profit.
  • Clarifies Assistant Adjutants General (AAGs):
    • The Adjutant General may appoint two Assistant Adjutants General — one from the Nevada Army National Guard and one from the Nevada Air National Guard.
    • AAGs serve at the pleasure of the Adjutant General and perform duties assigned by the Adjutant General.
  • Eligibility, grade, promotion and tenure:
    • Deputy TAG and AAG nominees must be federally recognized officers in the Nevada National Guard at the grade of colonel or higher and have at least 4 years of federally recognized service in the Nevada National Guard.
    • Appointments may be in grades up to brigadier general; the Governor may promote appointees to any grade not exceeding brigadier general.
  • Succession and Acting Adjutant General:
    • The Adjutant General must designate, by office regulation, the Deputy Adjutant General to serve as Acting Adjutant General in the Adjutant General’s absence.
    • If the Deputy TAG is unavailable, an Assistant Adjutant General may serve as Acting Adjutant General; if none are available, any National Guard officer may be designated.
    • Designated acting officers may continue to receive their authorized salary while serving.

Who is affected

  • Nevada National Guard senior leadership (Adjutant General, Deputy Adjutant General, Assistant Adjutants General).
  • Office of the Military (administrative/state personnel classification).
  • State budget/administration — fiscal note indicates an effect on the State (no effect on local government), though the enrolled bill does not specify amounts.

Rationale and expected impacts

According to the Office of the Military (sponsor/statement of intent), the Deputy TAG provides continuity of leadership, joint-force coordination across Army and Air components, improved state–federal coordination, and enhanced readiness and response capability during emergencies. The statute also removes prior references to “Chief of Staff for Army/Air” as unclassified positions and consolidates senior leadership titles consistent with common National Guard structures in other states.

Timeline and procedural history

  • Introduced: December 2, 2024 (prefiled Nov. 19, 2024)
  • Assembly and Senate amendments considered; Amendment No. 9 adopted (April 2025)
  • Passed both houses (Assembly: May 21, 2025; Senate: April 17, 2025)
