Summary of Bill S 4270 — Prohibition on Certain Advertisements by New Jersey Transit

Overview

Bill S 4270 proposes to prohibit the New Jersey Transit Corporation (NJT) from displaying or maintaining advertisements that promote gambling (casino games or sports pools), tobacco products, or vapor products on its properties or platforms. The measure would require NJT to adopt implementing regulations and would become effective on the first day of the third month following enactment.

Purpose and Intent

  • To restrict NJT advertising that could promote gambling, tobacco, or vapor products.
  • To ensure that any gambling-related advertising on NJT property that remains promotes prevention, education, and treatment for compulsive gamblers.
  • To empower NJT with rulemaking authority to implement the act.

Key Provisions

1) Definitions

  • Vapor product: Any device used to deliver aerosolized or vaporized substances to the user (e.g., e-cigarette, e-cigar, e-pipe, vape pen, e-hookah). Includes components, parts, accessories, and any substance that may be aerosolized or vaporized by such device, regardless of nicotine content. Excludes drugs, devices, or combinations approved by the FDA under the Federal Food, Drug, and Cosmetic Act.

2) Prohibitions on Advertisements (NJT)

  • NJT shall not display or maintain advertisements that:
    • (1) Propose the use of, or promote, a casino game or sports pool (including Internet casino or Internet sports pool) unless the ad promotes prevention, education, and treatment programs for compulsive gamblers (e.g., programs provided by the Council on Compulsive Gambling of New Jersey);
    • (2) Propose the use of, or promote, tobacco or tobacco-related products;
    • (3) Propose the use of, or promote, vapor products.

3) Rulemaking

  • NJT must adopt rules and regulations under the Administrative Procedure Act (APA) to effectuate the act’s purposes.

4) Effective Date

  • The act takes effect on the first day of the third month following enactment.

Who is Affected

  • Primary: New Jersey Transit Corporation (NJT) and its advertising operations.
  • Advertisers and Partners: Companies and organizations seeking to place ads on NJT properties or channels (gambling, tobacco, and vapor-product advertisers would be restricted).
  • Transit Riders: Public exposure to fewer gambling, tobacco, and vapor product promotions on public transit.

Legislative and Procedural Context

  • Introduced: March 17, 2025.
  • Status: Referred to Consumer Protection; subsequently listed as referred to Senate Transportation Committee.
  • Sponsor: Senator Brian Kavanagh (primary).
  • Related/Companion Legislation: A-3087 (companion); several prior-session related bills listed (e.g., A 5830, A 1117, A 4809, S 8149, S 2323, etc.).

Potential Impact

  • Public health and consumer protection emphasis by limiting exposure to tobacco and vapor products via transit advertising, and reducing gambling promotion outside education/treatment contexts.
  • Administrative burden on NJT to develop and implement new advertising rules.
  • Possible shifts in transit-ad revenue and advertising strategy, pending regulatory guidance and market responses.

If enacted, NJT would implement regulations under the APA to enforce these prohibitions and ensure compliance.
