Bill Summary · RC 460

Legislative bill overview

Bill RC 460 requires Puerto Rico's Controller (Comptroller), Yesmín M. Valdivieso, to deliver a comprehensive inventory of all ongoing investigations and complaints within the Controller's Office to the House of Representatives within 10 days of approval. The inventory must detail the procedural and administrative stage of each case, excluding routine audits, to preserve records and ensure continuity of investigations.

Why is this important

This resolution addresses institutional continuity and transparency in government oversight by documenting active investigations across the Controller's Office. Given that the Controller's position involves significant autonomy in investigating public corruption and fiscal irregularities, this inventory creates a formal record that protects ongoing work from being lost or deprioritized due to administrative changes or transitions in leadership.

Potential points of contention

  • Executive Independence vs. Legislative Oversight: The Controller's Office may argue that detailed inventories of active investigations could compromise confidentiality, obstruct ongoing cases, or infringe on the constitutional independence of the comptroller function
  • Resource and Burden Concerns: Compiling a comprehensive inventory within 10 days across potentially hundreds of cases may be administratively burdensome and could divert resources from actual investigative work
  • Access to Sensitive Information: Legislators gaining detailed knowledge of investigation details and stages could create political pressure, witness interference concerns, or premature disclosure of sensitive fiscal violations under investigation
