RCC 116 — Summary

Overview

RCC 116 is a resolution introduced on May 2, 2025, and currently referred to committees. It seeks to direct multiple government entities in Puerto Rico to undertake a coordinated set of actions relating to land in the Betances community of the Municipality of Ponce. The measure focuses on acquiring, segregating, and transferring land ownership to residents, providing property titles, and updating flood zone maps.

Purpose and Intent

  • Facilitate the acquisition of lands where Betances residents hold property, through the Department of Housing’s Title Authorization Program, at a nominal price of $1 or through the applicable legal procedures.
  • After acquisition, segregate (subdivide) the land and transfer title to the neighboring residents of the Betances community.
  • Provide property titles to Betances residents.
  • Exempt these residents from the income-eligibility requirements established in Law 132 of July 1, 1975, as amended.
  • Require the Municipality of Ponce to transfer to the Department of Housing the lands in Betances for $1, if the municipality holds title.
  • Instruct the Junta de Planificación to undertake the necessary actions to update the map of flood-prone zones.
  • Address related objectives tied to the above actions.

Key Provisions

  • Acquisition method: Nominal value of $1 or using the legal process, for lands where Betances residents’ properties are located.
  • Post-acquisition actions: Segregation and transfer of land titles to affected residents; issuance of titles to neighbors.
  • Eligibility relaxation: Exemption from the income-requirement criteria of Law 132 (1975, as amended) for those receiving titles.
  • Interagency transfers: Municipality of Ponce would transfer lands to the Department of Housing for $1 if it holds title.
  • Planning and mapping: Junta de Planificación to update the flood zones map to reflect current conditions and planning needs.
  • Scope: Focused on the Betances community in Ponce and related administrative procedures.

Affected Parties

  • Residents of the Betances community in Ponce (primary beneficiaries).
  • Department of Housing (as the lead agency for title acquisition and assignment).
  • Municipality of Ponce (land transfer responsibilities).
  • Junta de Planificación (update of flood-prone zones map).

Procedural and Timeline Aspects

  • Introduced: May 2, 2025.
  • Legislative actions:
    • May 2, 2025: Radicado (filed).
    • May 5, 2025: Appeared in Primera Lectura (First Reading) in the Cámara.
    • May 5, 2025: Referido a Comisión(es) (referred to committees).
  • Current status: Referido to committees; no enacted provisions yet.

Potential Implications

  • If adopted, could streamline land tenure for Betances residents and provide formal property titles.
  • The nominal $1 transfer approach signals a policy preference for official land consolidation or re-titling rather than market-rate sales.
  • Exemption from Law 132 income criteria may broaden eligibility for program benefits among residents.
  • Updating flood zone maps could affect future land use planning, insurance, and development decisions in the area.
  • As a resolution, the measure would primarily direct agency actions rather than create binding statutory law, depending on how committees and the Legislature implement or convert its directives.
