Legislative bill overview

Bill RCC 291 seeks to remove preservation and indivisibility restrictions previously imposed on a specific parcel of land (Property #34) in the Martineau subdivision located in Vieques, Puerto Rico. The restrictions were originally mandated under Law No. 107 of July 3, 1974, and the bill requires the Department of Agriculture and the Puerto Rico Planning Board to release these conditions from the property's legal registry.

Why is this important

Agricultural preservation laws like Law No. 107 restrict how land can be developed or divided to maintain productive capacity and prevent fragmentation of productive farmland. Removing these restrictions allows the property owner greater flexibility in how they use, develop, or sell the land, but eliminates protections that may have been intended to preserve agricultural use and environmental conservation in the area.

Potential points of contention

  • Agricultural policy reversal: The bill reverses decades-old farmland preservation policy for this specific property, which may contradict broader agricultural sustainability goals or existing land-use plans for Vieques
  • Environmental and conservation concerns: Law No. 107 restrictions often serve dual purposes protecting both agricultural productivity and natural resources; removal could enable development incompatible with Vieques' ecological sensitivity or existing zoning intentions
  • Precedent and selective application: Releasing restrictions for one specific property may invite similar requests from other landowners and raise questions about why this parcel receives preferential treatment over others subject to the same law
