RCC 155 — Summary

Overview

RCC 155 is a resolution introduced on June 17, 2025, currently in committee. The measure directs the LUMA Energy consortium to show cause within 30 days why its contract with the Government of Puerto Rico should not be canceled. If the Legislature determines there is sufficient cause for cancellation, an affirmative vote by the Legislative Assembly would authorize the process to formally request the Government of Puerto Rico to cancel the contract.

Purpose and Intent

  • Put forward a formal process for evaluating whether the LUMA Energy contract should be canceled.
  • Require LUMA to demonstrate, within a 30-day window, why the contract should continue.
  • Empower the Legislature to trigger a formal cancellation request to the executive branch if it finds sufficient grounds based on LUMA’s show-cause submission and legislative vote.

Key Provisions

  • Directive to LUMA Energy: Within 30 days, show cause why the contract with the Government of Puerto Rico should not be canceled.
  • Threshold for Cancellation: The measure contemplates a determination of “causa suficiente” (sufficient cause) for cancellation.
  • Legislative Action to Cancel: If sufficient cause is established, the Legislature, through an affirmative vote, would proceed to formally request the Government of Puerto Rico to cancel the contract.
  • Nature of Instrument: Classified as a resolution (not a bill), meaning it expresses the Legislature’s position and directs actions but does not by itself amend or create law.

Procedural Status and Timeline

  • Introduced: June 17, 2025
  • First Reading: June 19, 2025 (appears in Primera Lectura de la Cámara)
  • Referrals: June 19, 2025 (referido a Comisión(es))
  • Current Stage: Referido a commissions; subject to committee consideration and potential floor action
  • Practical Timeline if Adopted:
    • Adopt resolution and trigger 30-day show-cause period for LUMA
    • After submission, the Legislature would assess whether the cause is sufficient
    • If sufficient, the Legislature would vote to authorize the formal cancellation request to the Puerto Rico government

Affected Parties and Impacts

  • LUMA Energy consortium: Required to respond to the show-cause order within 30 days.
  • Government of Puerto Rico: Would receive a formal cancellation request if the Legislature approves.
  • Puerto Rico electricity sector and consumers: Potential implications for contract status, operational arrangements, and service expectations contingent on subsequent actions.
  • Legislative-Executive dynamics: Signals legislative intent and could influence ongoing negotiations or contract management discussions.

Notes

  • As a resolution, RCC 155 would express legislative intent and direct actions rather than create binding contracts or law; any actual cancellation would depend on subsequent executive action and the formal cancellation process, subject to applicable laws and contractual provisions. The bill text and committee deliberations will clarify procedural steps and potential legal implications.
