Legislative bill overview

Bill RCC 331 orders the Puerto Rico Department of Agriculture and Planning Board to release a specific parcel of land (Plot 12 in the "Vega Redonda" subdivision in Comerío) from agricultural preservation restrictions and indivisibility conditions imposed under Law 107 of 1974. The parcel is registered to Miguel Ángel Vélez Del Hoyo (deceased) and Myrta Milagros Rivera Colón.

Why is this important

This bill affects land use rights and property development potential for a specific landowner or their heirs. Removing agricultural preservation restrictions could allow the property to be subdivided, sold, or developed for non-agricultural purposes, representing a significant change in the property's legal status and commercial value.

Potential points of contention

  • Agricultural land preservation policy: Removing protections on agricultural lands may conflict with broader Puerto Rico agricultural conservation goals established in Law 107 of 1974
  • Precedent concerns: Approving this exemption could encourage similar requests from other landowners with restricted agricultural properties, potentially undermining the original preservation law
  • Beneficiary clarity: The bill involves deceased individuals and multiple heirs, raising questions about who legally benefits from the restrictions' removal and whether all heirs have agreed
