Legislative bill overview

Bill RCC 330 orders Puerto Rico's Department of Agriculture and Planning Board to release a specific parcel of land (Plot 2 of the "Vega Redonda" subdivision in Comerío) from legal restrictions on preservation and division that were imposed under Law 107 of 1974. The restrictions were originally placed on the property in a 1979 deed and the current owners are deceased.

Why is this important

This bill addresses a property rights issue affecting heirs or current stakeholders of deceased landowners. Removing these decades-old restrictions could enable development, sale, or subdivision of the land that has been legally constrained for over 45 years. The outcome will determine whether the land remains protected under agricultural/preservation policies or becomes available for alternative uses.

Potential points of contention

  • Preservation vs. development: Law 107 restrictions exist to protect agricultural land; removing them may conflict with Puerto Rico's land conservation goals
  • Beneficiary clarity: The original owners are deceased; clarity is needed on who legally benefits from releasing these restrictions and whether all heirs consent
  • Procedural specificity: The bill targets one specific property rather than addressing systemic issues with outdated restrictions, raising questions about fairness and precedent for similar cases
