Legislative bill overview

Bill RCC 329 seeks to remove agricultural preservation and indivisibility restrictions from a specific 0.25-hectare parcel (Plot 21) in the "Vega Redonda" subdivision in Comerío, Puerto Rico. These restrictions were originally imposed under Law 107 of 1974 and are currently registered against the property owned by the heirs of Monserrate De Jesús and Justina Rosario Morales.

Why is this important

This action would allow the property owners to freely develop, sell, or subdivide land that has been legally protected as agricultural property for nearly 50 years. The change could affect local land use patterns, agricultural preservation efforts, and the property's potential economic value or development options.

Potential points of contention

  • Agricultural preservation vs. private property rights: Removes protections designed to maintain productive agricultural land in a jurisdiction with limited arable territory
  • Precedent concerns: Lifting these restrictions for one parcel may encourage similar requests from other landowners with protected properties
  • Due process and stakeholder input: No indication of whether current agricultural agencies or municipalities were consulted, or if heirs of original restrictions imposed had voice in the decision
