Bill Summary · RCC 272

Legislative bill overview

Bill RCC 272 seeks to remove agricultural preservation restrictions and conditions (imposed under Law 107 of 1974) from a specific parcel of land (Plot 3 of the "Vega Redonda" subdivision) in Comerío, Puerto Rico. The property, registered to deceased owners Jacinto Meléndez Franco and Virginia Meléndez Castrodad, would be released from prior conservation and indivisibility mandates, potentially allowing its sale, subdivision, or conversion to non-agricultural use.

Why is this important

Agricultural preservation laws restrict how land can be used to maintain farming areas and food security. Removing these restrictions from this particular property could enable development or other uses, affecting local land use planning and potentially setting a precedent for similar requests. The bill also addresses a property with deceased owners, raising questions about inheritance and title clarity.

Potential points of contention

  • Agricultural policy impact: Removing protections from preserved farmland contradicts Puerto Rico's food security and agricultural sustainability goals, potentially reducing productive agricultural land
  • Precedent and equity: Granting exemptions to individual properties may encourage similar requests and raise fairness questions about why this property receives special treatment over others
  • Ownership and due process: The property's owners are deceased; clarity is needed on who requested this change, current legal ownership, and whether proper heir notification occurred
