Legislative bill overview

Bill RCC 273 directs Puerto Rico's Department of Agriculture and Planning Board to remove preservation and indivisibility restrictions imposed under Law 107 (1974) on a specific parcel of land (Plot 18) in the "Vega Redonda" subdivision in Comerío. The restrictions were originally placed on this property through a 1979 deed of sale and have remained in effect for nearly 50 years.

Why is this important

This bill affects property rights and land use flexibility for the current owners or heirs of the specified parcel. Removing these restrictions could enable development, sale, or alternative use of the land that was previously prohibited. The outcome impacts both private property interests and Puerto Rico's agricultural land preservation policies.

Potential points of contention

  • Agricultural preservation vs. private property rights: Law 107 was designed to protect agricultural lands; removing restrictions may undermine this public policy objective
  • Heir and ownership clarity: The original owners are deceased; ambiguity about current legal ownership and heir consent could complicate the process
  • Precedent concerns: Selective removal of restrictions could invite similar requests from other property holders, potentially weakening the entire preservation framework
