Legislative bill overview

Bill RCC 5 directs Puerto Rico's Land Authority (Autoridad de Tierras) and Planning Board (Junta de Planificación) to remove preservation and non-divisibility restrictions from a specific 13-acre parcel (Lot 28) in the Martineau subdivision located in Vieques, Puerto Rico. These restrictions were originally imposed under Law 107 of 1974 and were designed to protect the land from development and fragmentation.

Why is this important

This bill represents a significant policy reversal for a specific property, potentially opening the land for development or sale that was previously restricted to preserve its condition. In Vieques, where land use and development are contentious due to the island's history (former U.S. Navy bombing range) and environmental sensitivity, removing preservation restrictions could signal shifting priorities regarding land management and economic development in the municipality.

Potential points of contention

  • Environmental impact: Vieques has ongoing environmental remediation efforts from its Navy history; removing preservation restrictions may conflict with conservation goals
  • Property rights vs. public interest: The bill benefits the specific landowner while potentially removing public protections that existed for broader community benefit
  • Precedent setting: Removing restrictions on one parcel may encourage similar requests from other property owners, potentially dismantling the protective framework established in 1974
