Overview

Bill Number: PC 321
Title: "Ley para hacer Justicia a las Víctimas de Conductores bajo estado de Embriaguez y otras Sustancias Controladas"
Status: Ley 136-2025
Introduced: February 10, 2025

Purpose and Intent

The primary goal of this bill is to establish harsher penalties for individuals convicted of serious or fatal drunk or drugged driving offenses in Puerto Rico. The legislation aims to provide justice and accountability for victims and their families in cases where a driver's impairment has led to grave bodily harm or loss of life.

Key Provisions

  • Amends Article 2 of Law No. 259 of April 3, 1946, known as the "Probation and Parole Act", to mandate incarceration sentences in all cases of felony convictions and misdemeanor convictions stemming from violations of Articles 7.01, 7.02, or 7.03 of the Puerto Rico Vehicle and Transit Law (Law 22-2000) that result in serious bodily injury or death.
  • Removes the possibility of a suspended sentence or probation for these specific drunk/drugged driving offenses that cause grave harm or fatalities.
  • Subjects these convictions to the provisions established in Article 7.06 of the Puerto Rico Vehicle and Transit Law, which outlines penalties including fines and imprisonment.

Affected Parties and Impacts

  • Drivers convicted of felony or misdemeanor drunk/drugged driving offenses that result in serious injury or death will face mandatory incarceration sentences without the option of probation or a suspended sentence.
  • Victims and their families will have increased accountability and justice for the harms caused by impaired drivers.
  • The legislation aims to deter drunk and drugged driving by imposing stricter penalties, potentially improving road safety for all Puerto Rico residents.

Procedural and Timeline Considerations

This bill was introduced in the Puerto Rico legislature on February 10, 2025 and was subsequently passed into law as Ley 136-2025 on June 1, 2025. The new provisions will go into effect 90 days after the law's enactment, providing time for public awareness and implementation by the criminal justice system.
