Summary of Bill PC 790

Overview
Bill PC 790 proposes an amendment to Section 6.6 of Law Num. 8-2017, known as “Ley para la administración y transformación de los recursos humanos del Gobierno de Puerto Rico.” The core aim is to allow career employees to resign voluntarily in writing, with an effective date that can be immediate or set for a future date, and to establish procedural protections and regulatory requirements related to investigations that may follow a resignation.

Purpose and Intent
- Enable career employees to resign " libre y voluntariamente" (freely and voluntarily) by written notice to the agency’s appointing authority.
- Preserve the ability of the appointing authority to proceed with or initiate investigations within ten days of the resignation if conduct in the performance of duties is under review.
- Require agencies to adopt regulations governing administrative investigations into the conduct of resigning employees when there is a potential misconduct issue affecting the public service.
- Ensure due process protections during administrative proceedings.
- Require the appointing authority to communicate the investigation findings and conclusions to the resigning employee and to any other agency with jurisdiction to act on the conduct identified.

Key Provisions
- Voluntary resignation: Career employees may resign by written notice to the appointing authority, with immediate effect or a specified future date.
- Post-resignation investigations: The fact of resignation does not bar an agency from completing or initiating an investigation within ten days of the resignation.
- Regulatory framework: Agencies or government instrumentalities must approve regulations for administrative procedures governing investigations into resigning employees when warranted.
- Due process: Investigative procedures must honor essential due process requirements.
- Notification of findings: After the investigation, the appointing authority must notify the resigning employee and any relevant agency of the findings and conclusions.
- Scope: Provisions apply to “otros fines related” purposes, indicating broader related objectives.

Who is Affected
- Career employees considering or executing voluntary resignations.
- Appointing authorities and agency heads responsible for HR and investigative processes.
- Government of Puerto Rico agencies and instrumentalities subject to Law 8-2017.
- Potentially, other agencies that may receive findings or have jurisdiction over conduct-related actions.

Procedural and Timeline Aspects
- Introduced: August 19, 2025.
- First Reading: August 21, 2025.
- Referral: August 21, 2025 to Commission(s).
- Current status: Referred to Committees; no floor vote reported yet. Pending committee hearings and potential amendments.

Notes
- The bill is in early legislative stages and would require committee action, regulatory development by agencies, and potential floor votes to become law.
- The text focuses on balancing voluntary resignations with accountability and due process through post-resignation investigations.
