Legislative bill overview

Bill PS 890 amends Puerto Rico's 2019 Tax Incentives Code to require businesses receiving tax incentive decrees (particularly those promoting job creation or retention) to register and maintain active profiles on PERFIL, the Department of Labor's employment portal, and update job vacancies monthly. The requirement applies to employers who file quarterly unemployment insurance contributions.

Why is this important

Puerto Rico faces persistent unemployment challenges, and this bill attempts to bridge the gap between private sector job openings and jobseekers by leveraging tax incentive recipients as a conduit for labor market transparency. By mandating that beneficiaries of public tax breaks contribute to a centralized job matching system, the government aims to improve employment outcomes while creating accountability for those receiving public subsidies.

Potential points of contention

  • Compliance burden vs. benefit: Small and medium-sized businesses may view mandatory PERFIL registration and monthly updates as administrative overhead that reduces the value of tax incentives, potentially discouraging participation or creating enforcement challenges.
  • Data privacy and business confidentiality: Requiring detailed, real-time job vacancy disclosures could expose sensitive information about business expansion plans, organizational changes, or competitive hiring strategies that companies typically keep confidential.
  • Effectiveness and scope limitations: The mandate only applies to unemployment insurance filers, potentially excluding gig economy workers, contractors, and informal sector employers, limiting the portal's comprehensiveness and raising questions about whether compliance will meaningfully reduce unemployment.
