Legislative bill overview

Bill PC 1101 amends Puerto Rico's 2020 Condominium Law to strengthen unit owner protections, mandate administrative and financial transparency, establish criminal penalties for condominium-related misconduct, and expand access to judicial remedies through provisional rights orders. It also amends the 1974 Provisional Rights Law to explicitly include condominium disputes within its jurisdiction.

Why is this important

Condominium disputes in Puerto Rico have historically been difficult to resolve, leaving owners vulnerable to mismanagement and financial abuse by boards or administrators. These amendments directly address systemic governance gaps by creating clearer enforcement mechanisms, criminal accountability for fraudulent practices, and faster judicial access—potentially protecting thousands of property owners and their investments.

Potential points of contention

  • Property management industry resistance: Stricter regulations and criminal penalties may increase compliance costs for administrators and could face opposition from industry groups arguing overregulation threatens business viability
  • Scope of criminal conduct: Defining what constitutes criminal "condominium-related misconduct" with sufficient clarity to avoid vague enforcement or selective prosecution requires careful statutory language
  • Judicial system capacity: Explicitly adding condominium disputes to the Provisional Rights Law framework may strain already-overburdened Puerto Rico courts without corresponding resource allocation
