Summary of Bill PS 857

Bill Information

  • Bill Number: PS 857
  • Title: Para enmendar el sub inciso (f) del inciso (5) del Artículo 1.5 de la Ley 17-2019, según enmendada y conocida como “Ley de Política Pública Energética”
  • Status: Radicado
  • Introduced: October 14, 2025
  • Classification: Bill

Purpose and Intent

Bill PS 857 aims to amend the existing energy policy framework in Puerto Rico, specifically targeting the financial implications of energy efficiency programs on consumers. The primary intent is to ensure that the establishment of energy efficiency programs does not lead to additional charges on consumer electricity bills.

Key Provisions

The bill includes several significant provisions:

  1. Prohibition of New Charges:

    • The bill explicitly states that no new charges shall be imposed on consumers as a result of implementing energy efficiency programs.
  2. Cease and Desist Order:

    • It mandates the Negociado de Energía (Energy Bureau) to issue a cease and desist order to LUMA Energy and/or the Autoridad de Energía Eléctrica de Puerto Rico (Puerto Rico Electric Power Authority). This order would prevent these entities from continuing to charge consumers for energy efficiency costs.
  3. Credit for Consumers:

    • The bill requires the initiation of a process to provide a credit on electricity bills to each customer. This credit would compensate for any amounts previously charged under the energy efficiency fee.

Affected Parties

  • Consumers: The primary beneficiaries of this bill are electricity consumers in Puerto Rico, who would no longer face additional charges related to energy efficiency programs.
  • LUMA Energy and the Puerto Rico Electric Power Authority: These entities would be directly impacted by the cease and desist order, as they would need to halt the current billing practices related to energy efficiency charges.

Procedural Aspects

  • The bill was introduced and officially recorded on October 14, 2025. As it is currently in the "radicado" status, it is awaiting further legislative action or discussion.

Conclusion

Bill PS 857 seeks to protect consumers from additional financial burdens associated with energy efficiency programs while promoting transparency and accountability in the billing practices of energy providers in Puerto Rico. By prohibiting new charges and providing credits for past fees, the bill aims to enhance the affordability of energy for residents.
