Legislative bill overview

Bill PC 203 proposes amending Puerto Rico's Domestic Violence Prevention and Intervention Law to impose mandatory firearm license revocation and permanent prohibition on firearm ownership for individuals against whom two or more protection orders have been issued for domestic violence violations. The amendment targets repeat offenders identified through the domestic violence protection order system.

Why is this important

Domestic violence fatalities frequently involve firearms, making weapon access a critical safety factor in abuse cases. This measure seeks to reduce lethality risk by disarming individuals with documented patterns of domestic violence behavior, addressing a gap in current Puerto Rico law where multiple protection orders may not automatically trigger firearm restrictions.

Potential points of contention

  • Constitutional due process concerns: Permanent lifetime firearm prohibition based on protection orders (civil proceedings) rather than criminal conviction raises Second Amendment/constitutional questions about proportionality and appeals
  • Implementation and enforcement gaps: The bill doesn't specify verification mechanisms, database coordination between courts and firearms licensing authorities, or enforcement penalties for non-compliance
  • Scope ambiguity: Unclear whether "two or more orders" means current simultaneous orders or cumulative orders across different relationships/time periods, affecting how broadly the provision applies
