Legislative bill overview

Bill PS 1033 amends Puerto Rico's Notarial Law to establish mandatory, uniform notary fee structures with minimum tariffs and eliminates negotiation flexibility for notarial services. The bill requires immediate payment of all fees and penalties at the moment a public document is authorized, removing discretionary pricing currently allowed under existing law.

Why is this important

Notary services are essential for legal and real estate transactions in Puerto Rico, affecting businesses, property owners, and citizens regularly. Standardizing and increasing minimum fees could impact transaction costs for low-income populations and small businesses, while providing notaries with more predictable income and potentially reducing disputes over service charges.

Potential points of contention

  • Impact on vulnerable populations: Mandatory minimum fees may disproportionately burden low-income individuals and small businesses by removing cost negotiation options that currently exist
  • Business competitiveness: Eliminating pricing discretion could reduce notaries' ability to compete or offer discounted services to regular clients, potentially affecting market dynamics and service quality incentives
  • Fee structure details: The bill references new tariffs (subsections 4(e-h)) but the actual fee amounts are not detailed in this summary, making it unclear whether increases are modest or substantial
