Legislative bill overview

Bill PS 829 amends Puerto Rico's 1948 Work Day Law to require employers to provide employees with a detailed breakdown of hours worked and payroll information upon request. The bill aims to increase transparency in wage and hour documentation between employers and workers.

Why is this important

Wage theft and pay discrepancies are significant labor issues affecting worker financial security and legal protections. Clear documentation requirements help workers verify they receive proper compensation and can facilitate dispute resolution or legal action if violations occur. This addresses an information asymmetry where employers control payroll records but workers have limited access.

Potential points of contention

  • Compliance costs: Small businesses may argue that creating detailed hour breakdowns requires administrative burden and potential system upgrades, particularly for those using manual timekeeping
  • Definition ambiguity: The bill doesn't specify response timeframes, formats, or what constitutes reasonable documentation, potentially creating disputes about compliance
  • Enforcement mechanism: The legislation doesn't clearly establish penalties for non-compliance or how workers would enforce their right to records, limiting practical effectiveness
