Summary of Bill PC 154

What the bill would do

Bill PC 154 seeks to amend Article 4-G of Law No. 74 (the Puerto Rico Highway and Transportation Authority Law, enacted June 23, 1965, as amended). The core aim is to require that, starting January 2, 2025, any bidder for contracts involving the construction or repair of roads, sidewalks, curbs, drainage channels, sound barriers, and other related public works be informed that asphalt or asphalt concrete containing material derived from discarded tires (asphalt rubber) must be used as an essential raw material in the project.

Key provisions

  • Amend Article 4-G to mandate the use of asphalt rubber content in relevant projects as described above.
  • Implement a notification requirement to every interested bidder, effective January 2, 2025.
  • Include technical corrections to the law and address related purposes.
  • Scope covers a broad set of infrastructure elements, including roads, sidewalks, encintados (curbs), channels, stormwater management surfaces, and prefabricated sound barriers, among others.

Affected parties and materials

  • Bid applicants/contractors seeking awards for eligible public works.
  • The Puerto Rico Department/Authority responsible for highway and transportation projects (the authority referenced by Law No. 74).
  • Suppliers and producers of asphalt and asphalt rubber materials.

Implementation timeline and procedural status

  • Introduced: January 9, 2025.
  • First Reading: January 16, 2025.
  • Referred to Committees: January 16, 2025 (bill currently under consideration by committees).
  • No fiscal or funding provisions are specified in the information available; the bill is in the early committee stage.

Potential impacts and considerations

  • Environmental: promotes recycling by incorporating discarded tire material into asphalt, potentially reducing tire waste.
  • Economic/ procurement: may affect bid specifications, material sourcing, and pricing; may require updates to bid documents and supplier contracts.
  • Technical/standards: likely to necessitate established specifications for asphalt rubber content, quality testing, and compliance monitoring.
  • Administrative: procurement processes and review procedures may need adjustment to reflect the new material requirement.

Next steps

  • Committee review to determine technical details, implementation standards, and any fiscal implications.
  • Possible amendments to refine material specifications, sourcing requirements, and timelines.
