Bill Summary · PC 611

Overview: Bill Number: PC 611, Title: To amend Article 38 of Law 73-2019, as amended, known as the "General Services Administration Law for the Centralization of Purchases of the Government of Puerto Rico of 2019", in order to establish a cap of fifteen percent (15%) on the original amount of the contract in change orders to it, as well as to specifically establish the exceptions to this limitation when the Administrator certifies under oath the examination and compliance with the conditions provided and the request is accompanied, also, of an exception under oath and detailed by the head of the Government Entity or appointing authority that justifies said change order in excess of fifteen percent (15%) of the original contract amount; and for other related purposes.
Purpose and Intent: The main goal of this bill is to establish a 15% cap on change orders to government contracts, with specific exceptions that require sworn certification and justification by the contract administrator and government entity head.
Key Provisions:
- Establishes a 15% cap on change orders to the original contract amount
- Allows exceptions to the 15% cap if:
- The contract administrator certifies under oath that the conditions for the change order have been examined and met
- The government entity head provides a sworn, detailed justification for the change order exceeding 15%
Affected Parties and Impacts: This bill would impact government entities and contractors engaged in public procurement contracts. The 15% cap and exception process aims to provide more oversight and control over contract changes.
Procedural and Timeline Considerations: The bill has been referred to committee(s) for consideration. The next steps would be committee review, potential amendments, and a vote by the full legislature.
