Legislative bill overview

Bill PC 326 amends Puerto Rico's Vehicle and Transit Law (Law 22-2000) to require motorcyclists to use reflective devices between 6:00 p.m. and 6:00 a.m. The bill also grants the Secretary of Transportation and Public Works authority to adapt regulations implementing this requirement.

Why is this important

Nighttime motorcycle visibility is a significant traffic safety concern, as motorcyclists are inherently less visible than other vehicles and are overrepresented in fatal accidents during low-light conditions. This measure aims to reduce nighttime collisions and injuries through improved visibility while establishing regulatory flexibility for practical implementation.

Potential points of contention

  • Definition and enforcement ambiguity: The bill does not specify what constitutes adequate "reflective devices" (vests, tape, paint, etc.) or how police will determine compliance, potentially creating inconsistent enforcement
  • Burden on motorcyclists: Requiring mandatory reflective gear adds cost and compliance responsibility; some argue this unfairly targets one vehicle class without addressing other visibility issues or driver behavior
  • Regulatory discretion concerns: Granting broad authority to the Secretary to "adapt" regulations without legislative guidelines could lead to regulations exceeding the bill's intent or creating administrative burden
