Legislative bill overview

Bill PS 924 proposes to repeal Article 44 of Puerto Rico's 1902 Political Code, specifically removing provisions regarding the effects of law repeal that create crimes. The bill addresses obsolete language that became superseded by the 1952 Puerto Rico Constitution and subsequent legislation.

Why is this important

This is a technical cleanup measure that removes conflicting or redundant legal language from Puerto Rico's foundational code. Clarifying which laws remain in effect prevents confusion in criminal law interpretation and ensures the legal code reflects current constitutional authority rather than contradictory pre-1952 provisions.

Potential points of contention

  • Scope of repeal: Stakeholders may dispute whether removing Article 44 entirely is necessary or if selective amendment would preserve useful provisions while eliminating only truly obsolete language
  • Retroactive application: There could be concerns about whether this affects pending cases or convictions based on laws previously governed by Article 44's provisions
  • Definitional clarity: The bill's language about what constitutes "effects of repeal" may lack sufficient specificity, creating uncertainty about which specific criminal law provisions are actually being addressed
