Legislative bill overview

Bill PC 765 adds a new definition to Puerto Rico's 2024 Autism Spectrum Disorder law by establishing the legal definition of "Applied Behavior Analysis (ABA) Service Provider" and classifying them as healthcare professionals. The bill specifies required credentials for hiring ABA providers, delineates their scope of practice, and identifies excluded therapeutic services or modalities.

Why is this important

This bill clarifies the regulatory framework for ABA services in autism treatment, which affects access to care, professional standards, and insurance coverage for families with autistic children. Proper credentialing and scope-of-practice definitions protect service quality and prevent unqualified practitioners from providing behavioral interventions.

Potential points of contention

  • Credential requirements: Disagreement over which certifications (BCBA, RBT, or others) should be mandatory versus optional, potentially affecting practitioner availability and service costs
  • Scope of practice boundaries: Debate over what ABA providers can and cannot do, particularly regarding overlap with psychology, occupational therapy, and other established professions
  • Excluded services definition: Uncertainty about which therapeutic modalities are explicitly excluded could create ambiguity in implementation and lead to disputes over service reimbursement
