LB 10 — Summary (2025)

Status: Approved by the Governor (March 11, 2025). Became effective immediately under an emergency clause.

Primary sponsor: Sen. Jana Hughes; cosponsor: Sen. Hallstrom.

Purpose

LB 10 modifies Nebraska law governing wholesale drug distributors and the state Prescription Drug Donation Program to (1) exempt distribution activity under that donation program from state pedigree requirements and (2) authorize the Nebraska Department of Health and Human Services (DHHS) to directly receive, dispense, and distribute donated prescription drugs and supplies during (or in preparation for) a gubernatorial-declared state of emergency.

Key provisions

  • Amends section 71-7455, R.R.S. Neb.:
    • Wholesale distributors participating in the Prescription Drug Donation Program are not required to maintain the paper or electronic pedigree otherwise required under section 71-7456.
    • DHHS may receive prescription drugs and supplies directly under the Prescription Drug Donation Program Act and:
    • Dispense such drugs/supplies through licensed personnel during, or in preparation for, a state of emergency declared by the Governor.
    • Receive and distribute donated drugs/supplies to any individual who is impacted as a result of such a state of emergency. (AM12 replaced the term “victim” with “impacted.”)
  • Repeals the original section 71-7455.
  • Includes an emergency clause: the act takes effect when passed and approved.

Who is affected

  • Wholesale drug distributors that participate in Nebraska’s Prescription Drug Donation Program (reduced pedigree/documentation obligations for those donation transactions).
  • Nebraska DHHS (expanded authority to receive, dispense, and distribute donated prescription drugs and supplies in emergencies).
  • Individuals impacted by state-declared emergencies who may receive donated prescription drugs/supplies directly from DHHS.

Legislative and procedural timeline

  • Introduced: Jan 9, 2025; referred to Health & Human Services.
  • Committee hearing: Jan 22, 2025. Health & Human Services amendment AM12 adopted.
  • Passed Final Reading with emergency clause: 46–0–3 (Mar 6, 2025).
  • Presented to Governor: Mar 6, 2025. Approved: Mar 11, 2025. Effective immediately.

Considerations

  • Intended as a technical correction to exempt the state donation program from federal Drug Supply Chain and Security Act–related pedigree requirements and to streamline emergency response.
  • Tradeoffs to note (neutral): easing pedigree requirements may speed donation/distribution in emergencies but potentially reduces transaction-level traceability of donated products.
