Summary — LB 364 (2025)

Status: Approved by Governor (May 20, 2025)
Introduced: January 16, 2025 — Sponsor: Sen. Dan Quick (Legislature District 35)
Committee: Executive Board — Hearing: February 12, 2025
Final reading vote: 46–3–0 (presented to Governor May 14, 2025)

Purpose

LB 364 amends Neb. Rev. Stat. §37-342 to allow the Executive Board of the Legislative Council, when the Legislature is not in session, to approve the Nebraska Game and Parks Commission’s (the Commission’s) issuance of an “indication of intent” to incorporate land or facilities owned or developed by a local governmental subdivision or agency into the state park system. Previously, such an indication required approval by the full Legislature.

Key provisions

  • Amends §37-342 to permit approval of an indication of intent to incorporate local government–owned land/facilities into the state park system by:
    • the Legislature when in session; or
    • the Executive Board of the Legislative Council when the Legislature is not in session.
  • Requires the Commission, when seeking that approval, to provide the Legislature or the Executive Board with an estimated fiscal impact of the proposed incorporation, including:
    • the extent to which incorporation costs can reasonably be expected to be paid from cash funds; and
    • the extent to which costs will likely require General Fund appropriations.
  • Retains the existing caveat “Except as authorized in section 37-907,” i.e., does not alter any authorities or exceptions in §37-907.
  • Repeals the original version of §37-342 and harmonizes statutory language.

Who is affected

  • Nebraska Game and Parks Commission — procedural change for seeking incorporation approvals.
  • Local governmental subdivisions/agencies that own or develop land/facilities potentially being offered for incorporation into the state park system.
  • Legislative officers (Executive Board) — gains an interim approval role when Legislature is not in session.
  • State budget/public funds — fiscal-impact reporting requirement informs appropriations and potential General Fund exposure.

Procedure and timeline highlights

  • Referred to Executive Board: Jan 21, 2025; hearing Feb 12, 2025; advanced to General File Feb 27.
  • Designated Speaker priority bill March 17.
  • Advanced through Select File and Enrollment; placed on Final Reading May 6.
  • Final Reading passed 46–3–0 on May 14; Governor approved May 20, 2025.

Implications / considerations

LB 364 provides a mechanism for interim legislative-level approval (via the Executive Board) so the Commission may proceed with indications of intent outside the Legislature’s session calendar, while requiring fiscal-impact disclosure to inform decisionmakers and the public about likely funding sources and General Fund exposure.
