Status: Approved by Governor (signed April 3, 2025).
Introduced: February 3, 2025.
Statute amended: K.S.A. 2024 Supp. 65-1958.
Sponsor: Rep. Proctor (requested); House Committee on Commerce, Labor and Economic Development.
Purpose
- To replace/clarify the existing “demonstration” permit framework and explicitly authorize the Kansas State Board of Cosmetology (the Board) to issue (1) temporary location permits and (2) temporary guest artist permits, and to establish eligibility and administrative rules for those permits.
Key provisions
- Application and fee: Any person may apply for a temporary location or temporary guest artist permit on Board-approved forms and must pay the fee established under K.S.A. 65-1950.
- Temporary location permit: The Board may grant this permit to persons authorized under the cosmetology statutes. If the applicant is not licensed in Kansas, the Board may still grant the permit if the applicant:
- Is licensed to practice the regulated cosmetology profession in another state or jurisdiction; and
- Their out-of-state license has not been revoked, suspended, or conditioned.
- Temporary guest artist permit: The Board may grant this permit to allow a person to provide cosmetology services at a state/national convention, at an establishment licensed by the Board, or at another event location approved by the Board. If the applicant is not licensed in Kansas, the Board may grant the permit if the applicant holds an unrevoked/unrestricted license from another state or jurisdiction.
- Identification for foreign applicants: If an applicant is a foreign citizen who has not been issued a Social Security number and has not been licensed by any other state, the Board may not require a Social Security number and must accept a valid visa or passport identification number instead.
- Permit duration: Any permit issued under this section expires no later than 14 days after issuance.
- Rulemaking: The Board is authorized to adopt rules and regulations necessary to implement the Act.
- Technical corrections: The bill includes a technical drafting correction to the existing statute.
