In 2022, Colorado voters approved Proposition FF to provide free breakfast and lunch to all public school students regardless of family income. That measure funded the Healthy School Meals for All program by capping state income tax deductions for individuals with federal adjusted gross incomes above three hundred thousand dollars. Nonpartisan legislative analysts estimated the measure would generate just over one hundred million dollars in its first fiscal year. Under the stateβs Taxpayerβs Bill of Rights, any revenue collected for a voter-approved tax change that exceeds the official estimate must be refunded to taxpayers unless voters authorize retention. Proposition LL asks voters to allow the state to keep and spend approximately eleven to twelve million dollars collected in excess of the original projections from Proposition FF and to continue applying the deduction limits in future years to fund the healthy school meals program. The Healthy School Meals for All program not only covers the cost of free meals for students, but also supports local food purchasing, technical assistance for school nutrition staff, equipment upgrades, and increased wages for meal workers. Program advocates cite benefits such as improved student attendance, better focus in the classroom, and stronger graduation rates when children have reliable access to nutritious meals every school day. If Proposition LL fails, the excess revenue would be refunded to higher-earning households and the deduction limits would revert to levels that align with the original revenue estimates, potentially reducing funding for the program. While schools would continue to offer free meals in the near term, future funding for nutrition initiatives, equipment, and staff support could be significantly curtailed. Proposition LL is a legislatively referred state statute placed on the statewide ballot by the Colorado General Assembly to address the requirement that any excess revenue from a voter-approved tax change be returned unless voters permit retention.
