HB1178 - Human trafficking awareness training.

Human trafficking awareness training. Requires an owner or operator of a public lodging establishment (establishment) to: (1) provide human trafficking awareness training for employees; (2) post human trafficking awareness signage; and (3) implement procedures for the reporting of suspected human trafficking and a human trafficking prevention policy. Requires the department of homeland security (department) to make a list available on the department's website of approved human trafficking training courses. Provides that an owner, operator, or employee of an establishment that complies in good faith with the requirements is not liable for an act or omission arising out of or related to human trafficking committed by a third party unless the owner, operator, or employee knowingly and willfully assists in the commission of human trafficking. Requires the department to maintain a list of establishments that are not in compliance with the requirements. Requires a state agency to ensure that lodging for an employee of the state agency is booked in an establishment that is not on the list. Requires the department to adopt rules to implement the requirements, including rules establishing a schedule of fines for a violation.

School based health services and report. Requires the office of the secretary of family and social services (office) to submit a Medicaid state plan amendment to the United States Department of Health and Human Services to allow school corporations to seek Medicaid reimbursement for medically necessary school based Medicaid covered services (program). (Current law allows for the state plan amendment.) Sets forth requirements of the state plan amendment and program. Specifies how school corporations can expend the funds. Requires the office and the department of education (department) to each employ one employee for the program and to train school corporations concerning the program. Requires the department to conduct a study concerning workload levels for school based health providers who are licensed occupational therapists and licensed physical therapists. Specifies components to consider in determining a methodology and requirements of the study. Requires the department to submit a report of the study to the legislative council before November 1, 2024, and to post the report on the department's website.

Reserve deputy town marshals. Provides that a reserve deputy town marshal may not act in an official capacity as a reserve deputy town marshal unless the reserve deputy town marshal is wearing a distinctive uniform and identification authorized by the town marshal. Provides that, if the reserve deputy town marshal's official duties include patrolling with the use of a motor vehicle, the motor vehicle used as part of the reserve deputy town marshal's official duties must be marked as a police vehicle and identify the particular town served by the reserve deputy town marshal.

Provides that a person having the care of a dependent who recklessly, knowingly, or intentionally fails to secure a loaded firearm in the person's residence or vehicle commits neglect of a dependent, a Level 6 felony, if the dependent uses the firearm to cause bodily injury or death to any person. Enhances the offense to a Level 5 felony in particular instances. Specifies exceptions and defenses. Specifies sign requirements for retail dealers. Defines terms and makes conforming amendments.

Removes a provision requiring an APRN to operate under a collaborative practice agreement or the privileges granted by a hospital governing board. Removes certain provisions concerning the audit of practice agreements. Allows an APRN with prescriptive authority to prescribe a schedule II controlled substance for weight reduction or to control obesity. Makes conforming changes.

Trauma informed care. Requires the Indiana state board of nursing to study whether trauma informed care should be included as part of the required curriculum for nursing education programs. Requires an individual who holds an active license as a nurse and has direct patient contact to complete a trauma informed care training program within a specified time. Requires the employer of an employee who is required to obtain the training to maintain a record of the completion of the training in the employee's employment records. States that receiving the training as part of curriculum at a nursing education program satisfies the training requirement.
