Clarifies when a confirmed report may be expunged from the central registry, and establishes a process for expungement upon request. Takes effect 12/31/2050. (SD1)

Adds a penalty for failure to comply with reporting requirements under general excise tax law and transient accommodations tax law for collection of rent by a third party. Raises the unfair competition penalty under general excise tax law to adjust for inflation. Takes effect 1/1/2025. (SD1)

SB3082 - Relating To Title 24, Hawaii Revised Statutes.

Provides amendments to external review procedures to improve consistency with the National Association of Insurance Commissioners Uniform Health Carrier External Review Model Act. Requires health insurers, mutual benefit societies, and health maintenance organizations to cover mandated services for mammography at least as favorably as coverage for other radiological examinations.

SB3172 - Relating To Criminal History Record Checks.

Authorizes the Department of Corrections and Rehabilitation to search criminal histories and fingerprint records of current and prospective volunteers and purchase of service contracted and subcontracted service providers and their employees who are directly involved in providing correctional programs, treatment, and services to persons committed to a correctional facility or places them in close proximity to persons committed when providing services on behalf of the Department or the correctional facility.

SB3169 - Relating To The Certification Of Documents.

Establishes the Apostilles and Certifications Special Fund. Requires the Office of the Lieutenant Governor to set a fee for the issuance of an apostille or a non-apostille certification by administrative rules. Appropriates funds into and out of the special fund.

SB3075 - Relating To The Mortgage Loan Recovery Fund.

Clarifies the eligibility to recover from the Mortgage Loan Recovery Fund to include consumers aggrieved by the conduct of a mortgage loan originator licensee. Allows for the annual use of $50,000 of the fund for training the Division of Financial Institutions and its attorneys relating to the residential mortgage industry, providing training to licensees, developing educational materials for licensees in the area relating to licensure under this chapter, and educating the public in the area relating to residential mortgage loans. Increases the restitution available to consumers from the Mortgage Loan Recovery Fund to the amount of $150,000, bringing consistency to sections 454F-41 and 454F-42, HRS.

SB3141 - Relating To Mental Health.

Requires the Department of Health to track and publicly report certain data relating to crisis reports, emergency mental health transports, and court-ordered treatments. Requires the Department of Health to respond to reports about persons having severe mental illness who are in need of assistance, assess whether those persons may fulfill the criteria for assisted community treatment, and coordinate the process for an assisted community treatment order if indicated. Establishes that a court's denial of a petition for involuntary commitment shall serve as notification to the Department of Health that the person should be evaluated for assisted community treatment. Declares that the general fund expenditure ceiling is exceeded. Makes an appropriation to the Department of Health for software and data collection and publication. Makes an appropriation to the Department of Health for statewide education and training on policies related to emergency examination and hospitalization and assisted community treatment. Repeals the sunset date of Act 111, SLH 2017, which allows a patient who has been involuntarily committed to a psychiatric facility to be ordered to receive treatment over the patient's objection. Declares that the appropriations exceed the general fund expenditure ceiling for 2024-2025. Effective 12/31/2050. (SD2)

SB3037 - Relating To Promoting Pornography For Minors.

Amends the offense of promoting pornography for minors by allowing the prosecution of persons who provide pornographic materials to undercover law enforcement officers who represent themselves as minors for purposes of undercover operations. (CD1)
