LEGISLATIVE NOTE - Section 20 of the District of Columbia Housing Authority Act of 1999 (DC Law 13-105; DC Official Code § 6-219) required the DC Housing Authority (DCHA) to submit procurement regulations to the Council for approval. The law stated that “If the Council does not approve or disapprove the regulations, in whole or in part, by resolution within the 45-day review period, the regulations shall be deemed approved” (emphases added). On March 7, 2023, DCHA submitted PR25-141 along with a set of proposed procurement regulations, and requested passive approval pursuant to DC Official Code § 6-219. A 45-day review period commenced, and extended through mid-May due to the Council’s April recess. On May 2, 2023, during the 45-day review period, the Council passed PR25-198, the District of Columbia Housing Authority Procurement Regulations Emergency Approval Resolution of 2023, which approved the proposed regulations in part.
