Establishes the criminal offense of unlawful shipment of tobacco products. Includes electronic smoking devices and e-liquids within the definition of "tobacco products", as used in the Cigarette Tax and Tobacco Tax Law. Increases the license fee for persons engaged as wholesalers or dealers of cigarettes and tobacco products. Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and tobacco products. Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices and the sale of tobacco products. Effective July 1, 2023; provided that section 4 shall take effect on July 1, 2024, and section 5 shall take effect on December 1, 2024.

Adds purchasing of renewable energy technology systems as an eligible expense, and clarifies that training on new and existing manufacturing equipment is an eligible expense, for the Manufacturing Development Grant Program. Establishes a Hawaii Film Advisory Council within the Department of Business, Economic Development, and Tourism. Provides exemption for certified development of film studio facilities from taxes imposed under chapter 237, HRS. Amends the Motion Picture, Digital Media, and Film Production Income Tax Credit allowed under section 235-17, HRS, to (1) clarify and amend the requirement for an independent third-party certification, (2) increase the annual credit cap to $60,000,000 from $50,000,000, (3) extend the sunset date to January 1, 2039, and (4) expand the definition of "qualified production" to include streaming platforms. Establishes, exempt from chapter 76, and appropriates funds for the film industry liaison position.

Amends sections 286-102 and 286-181, HRS, to allow the exemptions to include use of motorcoaches, small buses, and vans for the school bus services, which may not meet school bus regulations but which shall otherwise meet vehicle requirements and qualifications set forth in chapter 19-143, Hawaii Administrative Rules, to the extent required by the Department of Transportation and the Department of Education, with the Department of Education providing Department of Education adult staff chaperone escorts of students while students are being transported between designated locations off-campus and designated locations on-campus.

Scott K. Saiki is a Democratic member of the Hawaii House of Representatives, representing District 26. He earned his BBA from the University of Hawaii at Manoa in 1980. Saiki was selected by the Democratic caucus as the Speaker of the House on May 3, 2017. Prior to his election to the legislature, Saiki was an attorney in private practice. His professional experience includes serving as an associate at Goodsill Anderson Quinn & Stifel Law Offices from 1984 to 1988, and partner at Saiki & Vimont Law Offices from 1988 to 2012.read less
