Requires the State to defend professionally licensed or certified state employees from civil actions when the employee was acting within the scope of their employment and was not grossly negligent or wanton, or failing to cooperate. Clarifies that the employee may employ their own attorney at the employee's own expense. Requires that if the State refuses to defend a state employee from civil actions on certain grounds, the Attorney General shall file a motion to withdraw as counsel.

Exempts the Department of Education from the electronic procurement system requirement for purchases of goods and services less than $100,000 and for purchases of construction less than $250,000.

Scott K. Saiki is a Democratic member of the Hawaii House of Representatives, representing District 26. He earned his BBA from the University of Hawaii at Manoa in 1980. Saiki was selected by the Democratic caucus as the Speaker of the House on May 3, 2017. Prior to his election to the legislature, Saiki was an attorney in private practice.
