Continues the alignment of Hawaii's money transmitters law with the provisions of the Model Money Transmitters Modernization Act, thereby enabling Hawaii to work within a network of states to license, supervise, and examine transglobal money transmission companies as a multistate system. Provides clarity and consistency of the tangible net worth provision using nationwide standards. Assesses the initial license fee of $5,000 for money transmitter applicants upon approval of the application. Adds as a permissible investment the receivables due to the licensee from its payment processors for debit or credit card transactions authorized by the licensee's customers for many transmission services obtained from the licensee. Prohibits retaliatory actions against a unit owner, board member, managing agent, resident manager, or association employee who takes lawful action in an effort to address, prevent, or stop a violation of the condominium law, the governing documents of the association, or any law, ordinance, rule, regulation, or code that impacts the association. Allows a unit owner, board member, managing agent, resident manager, or association employee to bring a civil action for retaliation in the district court or circuit court, whichever is appropriate, to allege a violation. Provides a claimant that brings a civil action for retaliation in the circuit court with the right to a jury trial. Prohibits an association from using association funds or reserves in a manner that would be considered retaliation in any lawsuit against a unit owner.

Part I: Requires the Real Estate Commission (Commission) to receive and investigate complaints by condominium unit owners against associations that are subject to condominium laws. Establishes a Condominium Ombudsman to receive and investigate complaints by condominium unit owners against the Commission regarding the Commission's foregoing duties. Requires the Condominium Ombudsman to issue findings within thirty business days after a complaint is filed. Part II: Prevents a simple majority of unit owners from immediately removing a director that was elected by cumulative voting during any regular or special meeting of an association. Takes effect 7/1/2491. (SD1)

Scott K. Saiki is a Democratic member of the Hawaii House of Representatives, representing District 26. He earned his BBA from the University of Hawaii at Manoa in 1980. Saiki was selected by the Democratic caucus as the Speaker of the House on May 3, 2017. Prior to his election to the legislature, Saiki was an attorney in private practice. His professional experience includes serving as an associate at Goodsill Anderson Quinn & Stifel Law Offices from 1984 to 1988, and partner at Saiki & Vimont Law Offices from 1988 to 2012.read less
